Could Oil/gas Drilling Come To Stapleton

Mineral rights under Stapleton land were nearly made available for auction last month, which would have allowed oil and gas operators to bid for the right to drill. By a 4-0 vote, influenced by public comment, the State Land Board rejected the idea, but what is going on?

For residents, the turmoil began with a neighborly posting on Facebook. Nick Kaczor, the assistant manager of the Rocky Mountain Arsenal National Wildlife Refuge , began his Jan. 16 post with, Dont shoot the messenger attached to a map and a link to a proposal before the Colorado State Land Board for its Jan. 18 meeting.

Retired Lone Tree geologist, Ron Pritchett, had nominated for auction the oil and gas drilling rights underneath four parcels of land whose mineral rights are controlled by the SLB. One of these tracts includes the north Stapleton neighborhoods of Conservatory Green and Willow Park, as well as part of the Northfield shopping area. One of the other parcels is in the center of the Refuge, another in Commerce City and the last in the Green Valley Ranch area.

What Is The Colorado State Land Board

The Land Board was created in 1876 as a condition of statehood, explained SLB director, Bill Ryan. When Colorado petitioned to become a state, the Federal Government said were going to grant you the land for your state, but section 16 and section 36 of every township is going to go into a trust to benefit the common schools. According to Ryan, This concept of land being used to support the schools really dates back to the founding of the country. The founding fathers thought that the key to a stable democracy was going to be an educated citizenry. The SLB is the second-largest landowner in Colorado, with 2.8 million surface acres and 4.0 million mineral estate acres in over 60 counties. The SLB can sell or lease surface rights but can only lease the underlying mineral rights. It does not operate businesses, instead selling or leasing the lands that are held in eight public land trusts for the benefit of public schools and institutions. According to its website, A dual mission guides State Land Board management of these assets: to produce reasonable and consistent income over time, and to provide sound stewardship of the state trust assets. The SLBs commissioners are appointed by the governor.

Looking To Other States

Few states have enforcement powers over HOAs.

Virginia and Nevada have ombudsmen to handle disputes between HOAs and their members. Florida has an ombudsman to mediate disputes between condominium homeowners associations and their residents but not anything for neighborhood HOAs, said Patrick Fargason, a Florida Department of Business and Professional Regulation spokesman said.

In Nevada, state law also regulates how much an HOA can charge for fines, setting a $100 cap for any violations that dont jeopardize the health, safety and welfare of residents, said Jason Wyatt, ombudsman for the Nevada real estate division. Fines levied over something that impacts public health and safety are capped at $1,000.


And an HOA cannot put a lien on a home and foreclose over unpaid fines in Nevada, Wyatt said. The HOA only is allowed to place a lien and start foreclosure proceedings if a homeowner fails to pay membership dues.

But Colorado does not have caps on fines, nor does it have a professional mediator or a state board to help resolve disputes.

Its time to rein in HOAs power in Colorado, said Abrhaley, who is fighting to keep his home.

Im going to fight for my house with my lawyer, he said. But I would like to see a long-term solution on this. This homeowners association is going too far. Its too much.

I will fight them. This isnt just about me. This is about hardworking homeowners.

    Green Valley Ranch Hoa Issues Statement About Unpaid Fines Foreclosures Amid Residents Claiming Hoa ‘power Trip’

    DENVER – The Master Homeowners Association for Green Valley Ranch issued a statement over growing community concerns the association is going too far with violation fines and subsequent foreclosures. Of the 119 foreclosures in Denver, 50 of them are within the HOA’s community.

    “The Homeowners Association of Green Valley Ranch creates curb appeal and increases property values by enforcing promises that the homeowners made to one another about the condition and upkeep of their properties,” the association wrote in a statement to CBS4. “The Colorado Common Interest Ownership Act authorizes the HOA to enforce fines and makes those fines an automatic lien on property.”

    Residents like Fronzo Gilkey say the HOA is targeting residents, unfairly issuing fines for minor issues.


    “We don’t need an HOA if this is the way they’re going to run with these ridiculous fines. There were people with $4,000 liens against their home,” Gilkey said.

    Gilkey used to serve on the HOA board, but says he got kicked out last year due to $1,400 in unpaid fines for things like his car parked next to his garage, an old dryer sitting outside waiting to be picked up from the city in a day, and a carpet on his front porch.

    “When I did get this position, I went to two or three meetings, even the board meetings, and this board gets excited… they went into the videos and the pictures of the violations, and I saw then that they were just on this power trip,” Gilkey recalled.
